Terms of Use

These Terms of Use ("Terms") govern your use of the Charmingo iPhone app and keyboard extension (the "App"), provided by Ruth Technologies, LLC ("we," "us," or "our"). By downloading or using the App, you agree to these Terms and our Privacy Policy.

1. Eligibility and license

You may use the App only if you can legally agree to these Terms. We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App on Apple devices you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

You may not copy, sell, sublicense, reverse engineer, bypass access controls, interfere with the App, use it unlawfully, or use it to violate another person's rights.

2. Compatibility and availability

On-device AI features require a compatible iPhone, a supported version of iOS, Apple Intelligence enabled, and a language supported by Apple Foundation Models. Features may be unavailable while Apple's model is downloading, when the device does not meet Apple's requirements, or where Apple Intelligence is unavailable.

We may improve, change, suspend, or discontinue features. We may also require an update when an older version is no longer safe or compatible.

3. Your content and privacy

You retain your rights in text, screenshots, prompts, and other content you provide. We do not claim a license to your private conversation content or generated output, and we do not use it to train AI models. Processing and storage are described in our Privacy Policy.

You are responsible for having permission to use content you provide and for reviewing generated text before sharing or sending it.

4. AI-generated suggestions

Charmingo provides writing suggestions, not professional advice. Generated text can be inaccurate, inappropriate, repetitive, or unsuitable for your situation. You decide whether to copy, insert, edit, share, or send any output and remain responsible for the messages you send.

Do not rely on Charmingo for emergency, medical, legal, financial, or other high-stakes decisions. Do not use it to harass, deceive, threaten, exploit, or impersonate others.

5. Purchases and subscriptions

The App may offer subscriptions and one-time purchases. Prices, duration, included benefits, and any trial terms are displayed in the App Store purchase sheet before you confirm payment.

• Payment is charged to your Apple Account.
• A subscription renews automatically unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your Apple Account subscription settings.
• Apple handles billing, refunds, family sharing, and purchase restoration under Apple's applicable terms.

Entitlements may end after expiration, cancellation, refund, revocation, or replacement by an upgraded subscription.

6. Intellectual property

The App, its software, visual design, branding, and other materials provided by us are owned by Ruth Technologies, LLC or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of those materials to you.

7. Disclaimers and liability

To the fullest extent permitted by law, the App is provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted operation or that every generated suggestion will be accurate or appropriate.

To the fullest extent permitted by law, Ruth Technologies, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Nothing in these Terms excludes rights or liability that cannot legally be excluded.

8. Termination and changes

You may stop using the App at any time. We may restrict access if you materially violate these Terms or misuse the App. We may update these Terms, and the date above will identify the latest version. Material changes will be communicated where legally required.

9. Governing law and contact

These Terms are governed by applicable law in the State of California, without limiting any mandatory consumer protections available where you live.
